CANDIDATES TERMS AND CONDITIONS

Please note that by registering with Busy Hands Contract Services recruitment agency, you unconditionally accept the terms and conditions set out in this agreement.

TERMS AND CONDITION FOR CANDIDATES

Busy Hands Contract Services is a company incorporated in England and Wales and whose registered office is at 27 Old Gloucester Street, London WC1N 3AX, which is an employment agency.

The Candidate approaches the Agency seeking to find a job opportunity and, by registration, agrees that the Agency may at its discretion utilise and disclose some of the information provided to the Agency by the Candidate. This is done in order to secure the Candidate an employment opportunity. All are subject to the provisions of this Agreement. The Agency uses social media (Facebook, Linked In, Twitter, Instagram, Google etc…) in order to secure a potential employment opportunity for the Candidate and by continuing to use the Agency services, the Candidate agrees to give permission for the Agency to do so.

1. Definitions

“Agency” means Busy Hands Contract Services and Busy Hands Cleaners Ltd, a company incorporated and existing under the laws of the United Kingdom, with a Registered Address at 27 Old Gloucester Street, London WC1N 3AX.

Busy Hands Contract Services is an international Recruitment Agency within the private household sector and acts in the United Kingdom as an employment agency.

“Candidate” means a person who is seeking work opportunities via the Agents’ services (you)

“Client” shall be any person, parent, family member, or third party appointed by such person named on the Client Registration Form for whom the Agency has agreed to provide the Services in accordance with these Conditions.

“Services” means the work-finding services provided by the Agency to the Candidate for the purposes of seeking to find that Candidate employment with a Client as set out in these Terms and Conditions.

“Introduction” means the process of introducing an Applicant by the Agency to the Client by providing a Curriculum Vitae and other information which identifies an Applicant(s). This includes the Applicant being interviewed by the Client either in person, by telephone or via video calling services (e.g. Skype, WhatsApp, FaceTime, etc.), for the purpose of further employment of that Applicant by the Client.

“Placement” means the employment, engagement, or use of the Candidate by the Client, or any third party to whom the Client has introduced the Candidate, on a permanent or short-term basis under any form of contract or relevant agreement.

“Permanent Placement” means a Contract of Employment exceeding 8 weeks (56 days).

“Temporary Placement” means a Contract of Employment not exceeding 8 weeks (56 days) which also includes trial working periods and will be charged according to our terms and conditions.

2. General

2.1. Any and all business undertaken by the Agency in relation to the Services is transacted subject to these Terms and Conditions.

2.2. The Candidate shall be deemed to have accepted and agreed to be bound by these Terms and Conditions upon their submission of his/her Candidate Registration Form.

3. The Services

3.1. Upon provision by the Candidate of a full and accurate curriculum vitae, which shall include information regarding their qualifications, training, experience, employment history, and any references. The Agency shall, at its sole discretion, search for suitable employment positions on behalf of the Candidate. The type of employment sought by the Candidate will be as detailed on the Candidate Application Form.

4. Candidate’s Rights & Obligations

4.1. The Candidate understands that the Agency is a referral and matching service only that provides its Clients with information respecting potential Candidates in exchange for a placement/Agency fee.

4.2. The Candidate agrees to release personal and contact information to the Agency that is complete, true, and accurate. The Candidate will also provide full details of previous work history, including contactable references on the agency’s request.

4.3. The Candidate consents to the disclosure of all relevant information which is reasonably required to progress any application. This includes but is not limited to, his/her curriculum vitae and copies of his/her qualifications, authorisations and/or references by the Agency to the Client. For the purposes of the Data Protection Act 1998 this consent extends also to disclosure to Clients based in a country outside the European Economic Area.

4.4. The Candidate agrees not to disclose the following information to prospective clients (parents) at the interview stage: full name, phone number, email address, postal address or any other forms of contact enabling the Client to contact the Candidate directly.

4.5. Immediately after any meeting or conversation between the Candidate and the Client, the Candidate must notify the Agency of the outcome of that meeting or conversation prior to any engagement.

4.6. When the Client offers a job opportunity, the Candidate agrees to immediately notify the Agency of all details concerning the role. The Candidate will not commence work on the Client’s behalf until instructed to do so by the Agency.

4.7. The Candidate acknowledges and agrees that they will not initiate employment with the Client or travel to the Client’s destination unless the Agency confirms that the full Placement fee has been paid by the Client.

4.8. The Candidate agrees to inform the Agency if the nature of the Candidate’s employment changes in any way during the first 12 months from the commencement of employment. If there is an increase in working hours or days compared to the originally required terms when the Candidate was initially hired.

4.9. The Candidate must notify the Agency immediately should he/she be offered employment directly or indirectly through the Client or should the Client contact the Candidate directly without the Agency’s permission

4.10. The Candidate should not engage at any time in any conduct which is detrimental to the interests of the Agency, would negatively affect the Agency’s relationship with the Client or is likely to bring the Agency into disrepute.

4.11. The Candidate agrees to comply with the Agency’s rules and requests, including refraining from travelling or commencing employment for the client prior to settling the Agency’s fee payment. She also agrees to stop her performance of duties in the event that the client fails to make payment to the Agency within 14 days.

4.12. The Agency has the authority to instruct the Candidate to cease working for that Client until the Agency fees have been paid, and the Candidate will do so with immediate effect.

4.13. If the Candidate was successful in earning money through an introduction via the Agency but failed to notify the Agency and continued earning, the Candidate agrees to reimburse the Agency with an Administration/Placement Fee.

4.15. When a Candidate accepts a job offer from the Client and throughout the duration of their employment, the Candidate is to disclose their agreed salary in full to the Agent upon request.

4.16. Should the candidate be contacted directly by the Client or their employees, acquaintances, family members, friends, or others associated with the Client, to whom the candidate has been introduced to through the agency within a 24-month period. The candidate will notify the agency immediately.

4.17. The Candidate agrees to provide reasonable assistance to the Agency in relation to any legal proceedings, claims, complaints, investigations, or enquiries (whether internal or external) concerning events or matters in which the Candidate was involved or of which the Candidate has knowledge including (but not limited to)

5. Confidentiality

5.1. The candidates must ensure total confidentiality of information, documents, documents and information of any kind concerning the clients of the Busy Hands Contract Services. The candidate could and has been able to have or have been aware of a possible job interview (physical interview, telephone interview or online).

5.2. The Candidates must not use a camera, video, mobile phone, smartphone or sound recording during an interview with clients, outside or inside their property, as well as in a public place.

5.3. The Candidates must not post or share photos, videos, recordings, or comments on social networks concerning the clients, families or homes (on the Internet, on Facebook, Twitter, Instagram, Google Plus, Blog and all social networks)

5.4. The Candidates must not disclose information, resell, to a private third party or to a company, or recruitment firm, the address, telephone number, the composition of the family, the composition of the interior of the home and any other client details.

5.5. The Candidate must be willing to sign a confidentiality agreement prior to starting the role.

5.6. The Candidate’s Information will be released only to Clients by a Recruitment Consultant employed by the Agency. Under no circumstance will the Agency release your personal or contact information to any third parties, or disclose it to prospective clients on our website, as per our Privacy Policy without your approval.

6. Warranties

6.1. The Agency does not provide any representations or warranties to the Candidate regarding any Client. The Agency provides only an introduction service between the Candidate and prospective clients and will refer their name and portfolio to suitable clients. The Agency cannot guarantee a Candidate will be interviewed or hired by any prospective Clients, nor can the Agency warrant the length of employment the Candidate will have once hired. Any Candidate/Client interviews, police checks, CRB checks, First Aid and other training required will be the responsibility and expense of the Candidate.

6.2. The Candidate must discuss and confirm the wages (for trial, temporary, or permanent positions) and all working conditions directly with the Client during their interview stage, and request the Client to sign a Work Agreement prior to beginning any type of work – trial, temporary or permanent. The Agency cannot be held responsible for negotiating any wages, loss of wages, termination of employment, and changes in the working conditions that result or may result from working for the Client.

6.3. The candidate is under no legal obligation to work for a particular Client and may request to be placed in another placement at their discretion. The Candidate hereby releases Busy Hands Contract Services Agency and its officers, agents, employees, and affiliates from all claims, liabilities, injuries, demands, suits, actions, and causes of actions of every kind arising out of or resulting from the action of the Agency or the release of any information by the Agency.

6.4. The above parties agree that the Agency shall not be liable to the Candidate, or to any other person, including, but not limited to the Candidate’s family or their successors, heirs and assigns, or any other person, for incidental or consequential losses, damages or expenses, directly or indirectly arising from any action or failure to act by a client. It is agreed that there is no representation, warranty, collateral agreement or condition affecting this agreement except as expressed in it.

6.5. The Candidate acknowledges having read, understood and agreed to the terms and conditions of this agreement which are set forth herein.

7. Agency Referral Fees

7.1. For the avoidance of doubt, the Agency DOES NOT charge any sign-up fees, registration and introduction to potential Employees. The Agency seeks to charge the Employer and will only charge the Candidate if the terms of this contract are broken by the Candidate.

7.2. In the event that a Candidate accepts a Job Offer from a Client and the Client refuses to pay the Agency placement fee, but the candidate continues to work for the Client ignoring instruction from the Agency to stop working, the Candidate agrees to reimburse the Agency an Administration Fee of 20% of their annual gross earnings on a monthly basis.

7.3. If the Candidate hides to the Agency important information (such as the starting date, the salary, the type of contract, etc.) or gives to the Agency false information (such as pretending that he/she is not really working for the client etc.) related to a Client who hired her/him without disclosing it to the Agency trying to bypass the Agency Fees, the Candidate is responsible to pay to the Agency a penalty corresponding in the full amount of the Commission Fee that should have been paid by the Client to the Agency.

8. Liability

8.1. The Agency shall not be liable for any of the following:

8.1.1. Any loss suffered by the Candidate by reason of the Candidate’s decision to resign from his/her current employment or engagement before or after receipt of a Client’s offer of employment. Furthermore, the Agency does not accept any responsibility and shall not be liable for any loss suffered by the Candidate by reason of the Client withdrawing the offer of employment at any time for any reason.

8.1.2. The loss of any data, CV or other materials submitted by the Candidate;

8.1.3. The failure of the Candidate to secure employment with any of the Agency’s Clients;

8.1.4. Any loss or damage of any kind, howsoever caused, arising out of the negligence, misconduct, dishonesty, breach of faith or breach of contract on the part of any Client; and

8.2. Nothing in these Terms and Conditions shall exclude or otherwise restrict the Agency’s liability for death or personal injury arising out of its own negligence.

9. Other terms

9.1. The Agency and the Candidate acknowledge that there is no employee/employer relationship between them.

9.2. The Candidate cannot work for other clients using the Busy Hands Contract Services name and reputation.

9.3. The Agency has the right to terminate the agreement with the Candidate at any time, for any reason, including but not limited to unprofessional conduct, misrepresentation of our image, and company name, lateness, no-showing, drug or alcohol abuse, previous or current criminal record.

9.4. In the event that the Candidate wishes to terminate their contract of employment within three months of commencement of the same, the Candidate will notify the Agency in writing setting out the reasons for the termination.

9.5. The candidate will work for the clients under a Contract of employment or Contract for Services, which is a separate agreement from this one.

9.6. The Agency may revise these Terms and Conditions from time to time. In the event that modifications are made, details of them will be published forthwith on the Agency website, the Agency will contact the Candidate to give him/her reasonable advance notice of the changes.

10. Law and jurisdiction

These terms and conditions are covered by English law, and all disputes arising out of or in connection therewith shall be subject to the jurisdiction of the English courts.
